Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the social media scheduling, publishing and AI-assisted content platform (the "Service") operated by The Social Atelier ("we", "us", "our" or "The Social Atelier"), located in the Netherlands. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

2. Your Account

You must provide accurate, current and complete information when creating an account and keep it updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. We may suspend or terminate access if we believe your account has been compromised or if you violate these Terms.

You represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business.

3. Social Platform Integrations

The Service integrates with third-party social platforms including, but not limited to, TikTok, Meta (Instagram and Facebook) and LinkedIn. When you connect a social account, you authorise us to access and use it through the platform's official API, within the permissions you grant.

Connecting a platform may require you to authenticate via OAuth. By doing so, you grant us a limited right to access the access tokens and perform actions on your behalf, including scheduling and publishing content, reading account insights where available, and managing posts. You may disconnect any platform at any time, which revokes our access.

4. Publishing Content on Your Behalf

The Service allows you to schedule and publish content to your connected social accounts. You retain full ownership of and responsibility for all content you publish. You grant us a non-exclusive licence to host, store, transmit and publish that content to the platforms you have connected, solely to operate the Service.

We are not liable for content you publish, including any consequences such as removal, shadow-banning, account restrictions or enforcement actions taken by a third-party platform. You are responsible for ensuring your content complies with each platform's terms and community guidelines.

5. AI-Assisted Content Generation

The Service may offer AI-assisted content generation, including captions, ideas and copy suggestions. AI-generated output is provided as a starting point and may be inaccurate, biased or inappropriate. You are responsible for reviewing, editing and approving all content before publishing. We do not guarantee that AI-generated content will be free of errors or suitable for your brand.

You agree not to use AI-assisted features to generate unlawful, infringing, deceptive or harmful content, including content that violates intellectual property rights, privacy rights or platform policies.

6. User Responsibilities

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of, any third party. You are responsible for all content you submit and publish, and for ensuring you hold the necessary rights and permissions for any media, music, trademarks or likenesses it contains.

You agree not to misuse the Service, including by attempting to access data you are not authorised to access, interfering with platform rate limits, or automating actions outside of the provided scheduling tools.

7. Third-Party Platforms and APIs

The Service relies on third-party platforms and their APIs (TikTok, Meta, LinkedIn and others). We do not control these platforms and are not responsible for their availability, changes to their APIs, pricing, policies or enforcement actions. Any use of third-party platforms is also subject to their respective terms of service and policies, which you must comply with independently.

If a platform revokes API access, changes permissions, or disables your account, our ability to provide the Service for that platform may be affected without notice.

8. Access Tokens and Authentication

When you authenticate with a social platform, we receive and store access tokens and related credentials needed to operate the Service on your behalf. We store these tokens securely and use them only to perform the actions you request. We do not share your tokens with third parties except as required to publish content to the platform you connected.

You may revoke access at any time through the Service or directly through the platform, which invalidates the associated tokens.

9. Intellectual Property

The Service, including its design, software and branding, is owned by The Social Atelier and protected by intellectual property laws. Content you upload remains yours. We may use aggregated, anonymised data to improve the Service, but will not sell your personal content.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, secure or that results will meet your expectations. We disclaim all warranties, express or implied, to the extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, The Social Atelier shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of revenue, data, profits or goodwill, arising out of or related to your use of, or inability to use, the Service. This includes losses caused by third-party platform actions, API changes or content enforcement.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we are required to do so by law or a third-party platform. Upon termination, we will delete your data in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
